Update on Legal Proceedings Regarding California’s Textile EPR Program

Update on Legal Proceedings Regarding California’s Textile EPR Program

On September 17, 2026, the Superior Court of California, County of Sacramento, issued a ruling denying the motion for preliminary injunction filed by the American Apparel & Footwear Association (AAFA) in its challenge to CalRecycle’s approval of Landbell USA as the Producer Responsibility Organization (PRO) under California’s Responsible Textile Recovery Act of 2024 (SB 707).

The Court’s ruling means Landbell USA may continue to perform its responsibilities as the approved PRO while the underlying litigation proceeds to a full hearing on the merits.

In evaluating the motion, the Court found that AAFA had not demonstrated the immediate and irreparable harm required to justify preliminary injunctive relief. The Court also determined that halting PRO activities would adversely affect the public interest by disrupting implementation of the Act and interfering with statutory deadlines. In addition, the Court concluded that AAFA did not establish that its claims concerning Landbell USA’s qualifications, nonprofit status, governing board, and financial controls are likely to be successful when a full hearing on the merits is held.

As to the hearing, the Court noted that AAFA was responsible for setting the full hearing after meeting and conferring with opposing counsel, but had not done so, suggesting a lack of urgency. on AAFA’s part. AAFA finally scheduled the hearing for March 12, 2027.

Landbell USA remains focused on fulfilling its responsibilities under SB 707 and supporting the continued implementation of California’s textile stewardship program in accordance with the law.
